KourierX Privacy Policy

User privacy is a central concern for Logi and Kourier Logistic Private Limited ("KourierX"). KourierX has formulated this "Privacy Policy" detailing the acquisition, utilization, disclosure, and retention of User information. Users are encouraged to acquaint themselves with KourierX's privacy practices. By utilizing the KourierX App or Site, users explicitly consent to KourierX's handling of their Personal Information in accordance with this Privacy Policy. This policy is considered integrated into the Terms & Conditions, available at https://kourierx.com/privacypolicy , and supersedes any inconsistencies or ambiguities between the two. Users are also bound by the applicable Third Party Privacy Policies. This Privacy Policy, along with any amendments, read with Third Party Privacy Policies, establishes a binding agreement between KourierX and the User. KourierX commits to notify users of significant changes through the App, Site, or alternative means, such as email, and continued use after such notice indicates the user's consent to the changes. Users are advised to periodically review the Privacy Policy for the latest information on KourierX's privacy practices.

For the purpose of this Privacy Policy, where context dictates:

1.Acceptance
  • 1.1. By accessing, registering, browsing, uploading, posting, or otherwise using KourierX Services or otherwise providing information on the KourierX Platform (hereinafter referred to as “Platform”), User agrees that their Personal Information (as defined below) shall be handled in accordance with this Privacy Policy.
  • 1.2. By impliedly or expressly accepting this Privacy Policy, the User also agrees to have read and be bound by and accepts:
  • 1.2.1. all of KourierX’s policies (including but not limited to Terms as amended from time to time);
  • 1.2.2. any plan limits, product disclaimers, or other restrictions presented to User on the Platform;
  • 1.2.3. any applicable Third Party Privacy Policies.
  • 1.3. User acknowledges and agrees to the collection, retention, and use of the information the User discloses to KourierX in accordance with this Privacy Policy, including but not limited to User’s consent for sharing User information as per this Privacy Policy.
  • 1.4. User also acknowledges and agrees that with respect to certain activities, the collection, transfer, storage, and processing of User information may be undertaken by trusted third-party partners or affiliates or agents of KourierX such as credit card processors, insurance companies, web hosting providers, communication services, and web analytic providers, to help facilitate KourierX in providing certain functions.
  • 1.5. Unless stated otherwise, this Privacy Policy applies to all information that is disclosed by the User on the Platform.
2. Collection and Use of Personal Information
  • 2.1. KourierX may gather and utilize information capable of identifying or contacting an individual (“Personal Information”), encompassing, but not limited to:
  • 2.1.1. When the User directly accesses the Platform, KourierX collects information, including but not limited to: - Name
    - Email
    - Telephone number
    - Postal address
    - Profile picture
    - Payment method
    - Items requested for KourierX Services
    - Other user-provided information.

      2.1.2. Information Automatically Collected


    • In compliance with Applicable Law, KourierX may collect information by automated means, including:
      - Location Information: Precise delivery location data and approximate IP address location.
      - Contacts Information: Names and contact details from the User’s address book.
      - Transaction Information: Details related to KourierX Services use, including service type, date, time, amounts charged, and distance of delivery.
      - Usage and Preference Information: Information about User interactions, preferences, and settings through cookies, pixel tags, and similar technologies.
      - Device Information: Details about the User’s Device, including hardware model, operating system, unique identifiers, and mobile network information.
      - Call and SMS Data: Call details, SMS content, and server logs when interacting with KourierX Services.

      • 2.1.3. Information Collected from Other Sources

    • KourierX may receive and combine information from other sources, such as:
      - Linking accounts with payment providers or social media services.
      - User ratings from Couriers.
      - Interactions with other KourierX-provided apps.
3. Sensitive Personal Information
  • 3.1. “Sensitive Personal Information” refers to data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, and the processing of genetic data, biometric data, health-related information, or information concerning a person’s sex life or sexual orientation
  • 3.2. KourierX does not require, collect, or process Sensitive Personal Information of the User.
    • 4. Manner of Dealing with Personal Information
  • 4.1. Personal Information submitted to the Platform will be used for specified purposes, including but not limited to:
    - Providing, maintaining, and improving KourierX Services.
    - Internal operations to prevent fraud, troubleshoot bugs, conduct data analysis, and monitor usage trends.
    - Facilitating communications between Users and Couriers.
    - Sending communications of interest to the User and personalizing KourierX Services.
  • 4.2. KourierX uses the User’s usage data (“Usage Data”) to diagnose problems, maintain servers, enhance the Platform, and provide reports for internal analysis and marketing solutions.
  • 4.3. Usage Data may be provided to third parties in an aggregated or anonymized form, without personally identifying information.
    • 5. Cookies and Other Technologies
  • 5.1. KourierX employs data collection services like “cookies” to analyze platform flow, measure promotional effectiveness, and enhance trust and safety. Certain features are exclusively accessible through these “cookies.” Additionally, KourierX uses cookies to reduce password frequency during sessions and deliver targeted information based on user interests. Most are “session cookies,” automatically deleted at session end. Users can decline cookies if their browser permits, though this may affect specific features, requiring more frequent password entry. A “cookie” is a small piece of information stored on a web browser by a web server, enabling the browser to recall information specific to a user. KourierX utilizes both permanent and temporary cookies, containing no personally identifiable information.
  • 5.2. Upon user registration, KourierX assigns a personal identification number, sent to the user’s hard drive as a “cookie.” This unique code, specific to each user, facilitates seamless navigation, allowing the user to use the platform without frequent password entry or re-filling registration forms.
    • 6. Potential Disclosure
    • 6.1. Sharing of Personal Information
    • 6.1.1. KourierX may share the User’s Personal Information with:
      (i) The Couriers to enable them to provide the Courier Services. For example, KourierX may share the Client’s name, average Client rating given by other Couriers, and pick up and delivery locations of goods/parcels with the Couriers;
      (ii) The general public if the User submits content on a public forum, such as blog comments, social media posts, or other features of KourierX Services that are viewable by the general public;
      (iii) Third parties with whom the User chooses to let KourierX share information, for example, other apps or websites that integrate with KourierX’s API or KourierX Services or those with API or Service which are integrated by KourierX;
      (iv) Third parties with whom the Courier chooses to let KourierX share information, including Clients, insurance agents, and insurers
    • 6.2. Other Important Sharing
      6.2.1. KourierX may share User’s Information with:
      (i) KourierX’s subsidiaries and affiliated entities that provide services or conduct data processing on behalf of KourierX or for data centralization and/or logistics purposes;
      (ii) Vendors, consultants, marketing partners, insurance service providers, communication service providers, and other service providers who need access to such information to carry out work on behalf of KourierX or to enter further into the agreement with the Couriers individually;
      (iii) In response to a request for information, by a competent authority, summons, court orders, or other legal or quasi–judicial processes if KourierX believes that disclosure is in accordance with or is otherwise required by any applicable law, regulation, or legal process;
      (iv) Law enforcement officials, government authorities, or other third parties if KourierX believes the User’s actions are inconsistent with the Terms, Privacy Policy, or any other policies of KourierX to protect the rights, property, or safety of KourierX or others;
      (v) Respond to claims that an advertisement, posting, or other content violates the rights of a third party; or protect the rights, property, or personal safety of the User or the general public;
      (vi) In connection with, or during negotiations of any merger, sale of company assets, consolidation, or restructuring, financing or acquisition of all or a portion of KourierX’s business by or into another company;
      (vii) If KourierX otherwise notifies the User and User consents to the sharing; and
      (viii) In an aggregated and/or anonymized form which cannot reasonably be used to identify the User
    • 6.3. KourierX may share Personal Information with its affiliates and authorized agents, representatives, auditors, and advisors to help detect and prevent identity theft, fraud, and other potentially illegal acts; correlate related or multiple accounts to prevent abuse of KourierX Services; and to facilitate joint or co-branded services that the User requests where such services are provided by more than one corporate entity. Those entities and affiliates may not market to the User as a result of such sharing unless the User explicitly opts-in.
    • 6.4. KourierX may share User’s Personal Information with third parties to conduct a basic verification of information provided by the User. Where the User is a Courier, KourierX will share such Personal Information with the Client.
    7. Contact Information
    • 7.1. KourierX may also seek permission for the Platform’s collection and syncing of contact information from the User’s Device per the permission system used by the operating system of the Device. If the User initially permits the collection of this information, iOS Users can later disable it by changing the contacts setting on their Device. The Android platform does not provide such a setting

    8. Termination of Account and Retention of Data Provided by the User
    • 8.1. Personal Information of the User will not be retained on the Platform, and KourierX will delete the same once the Account is deleted by the User
    • 8.2. Notwithstanding anything contained herein, information submitted by the User shall be retained by KourierX under the following circumstances:
    • 8.2.1. To the extent as may be required under Applicable Law;
    • 8.2.2. KourierX may retain User’s Personal Information as may be relevant for any ongoing or prospective legal proceedings; and
    • 8.2.3. In the exercise of lawful rights, which includes without limitation providing information to third parties for the purposes of prevention and reducing credit risk.
    9. Access and Updation of Personal Information
    • 9.1. As a registered User, your Personal Information can be viewed through your KourierX Account, which is protected by a password
    • 9.2. You represent and warrant that any and all information, including but not limited to Personal Information, is absolutely correct and complete in all aspects and does not belong to another person. You further undertake to immediately update any change or variation in your Personal Information on the Platform by sending KourierX a request in writing. Once you communicate the request to KourierX, you agree to comply with the instructions and information requests as may be provided/communicated by KourierX.
    • 9.3. The update shall be effective from future transactions and shall not be valid for ongoing transactions under process. An update may result in an increase in price. The Personal Information should not be changed without intimation.
    10. Protection of Personal Information
    • 10.1. Your Personal Information is never shared outside KourierX without your permission, except under conditions explained above. Within KourierX, Personal Information is stored in password controlled servers with limited access to members and other personnel or consultants on a need-to know basis.
    • 10.2. KourierX employs security measures to protect your information both online and offline from access by unauthorized persons and against unlawful processing, accidental loss, destruction, and damage.
    • 10.3. KourierX’s service providers and agents are contractually bound to maintain the confidentiality of Personal Information and may not use the information for any unauthorized purpose.
    • 10.4. KourierX ensures that all financial transactions undertaken through the Platform are protected by encrypted technology
    • 10.5. You acknowledge that despite the deployment of secure measures for the protection of your information on the Platform, the exchange and transmission of information online come with inherent security risks, and KourierX makes no guarantee regarding the safety of such transmission of your information through the Platform.
    11. Third-Party Sites, Services, and Third-Party Privacy Policies
    • 11.1. The Platform may contain components of services provided by TSPs and/or links to the programming interface of TSPs. Information, including Personal Information, exchanged between the User and third parties, such as TSPs, is not covered by this Privacy Policy. User shall be bound by the privacy policies of such third parties, and those policies are deemed to be incorporated herein.
    • 11.2. KourierX Services may integrate with social sharing features and tools allowing Users to share actions on KourierX Services. User’s use of such features may share Personal Information with friends or the public, based on established settings. Refer to the privacy policies of social sharing services for more information on how they handle User data
    • 11.3. If the User accesses and/or uses third-party websites linked in the Platform, such websites are governed by the privacy policies of those third parties. KourierX is not responsible for the information practices of such third parties.
    12. Consent
    • 12.1. By using the Platform and/or providing information, the User consents to the collection, retention, and use of disclosed information in accordance with this Privacy Policy, including consent for sharing information as outlined herein.
    • 12.2. User acknowledges that certain activities may involve third-party vendors or agents of KourierX for the collection, transfer, storage, and processing of information to facilitate specific functions.
    • 12.3. This Privacy Policy is subject to change without notice. Users are advised to periodically review the policy to stay informed of any changes.
    • 12.4. Users agree to be bound by the terms and conditions of this Privacy Policy by visiting the Platform. Non-agreement with these terms and conditions should deter Users from using or accessing the Platform
    • 12.5. Unless stated otherwise, this Privacy Policy applies to all information KourierX has about the User and their account.
    • 12.6. Any changes to the Privacy Policy will be posted on this page, keeping Users informed about the information collection, usage, and disclosure practices.
    13. Links
    • 13.1. The Platform may contain links to third-party websites. When leaving the Platform, Users should review the privacy policy of such websites, as this Privacy Policy solely pertains to information collected on the Platform.
    14. Advertisement and Analytics Services
    • 14.1. KourierX may enlist others for audience measurement, analytics, and serving advertisements across the internet.
      These entities might employ technologies like cookies and web beacons to identify the User’s Device during Platform visits and usage of KourierX Services, as well as on other online sites and services.
    15. Changes to the Privacy Policy
    • 15.1. This Privacy Policy is subject to modification, and any revisions will be posted on the Website.
      Users are advised to stay informed about the information collection, usage, and disclosure practices.
      All information submitted through the Platform is bound by the terms and conditions of this Privacy Policy, as updated. Continued use of the Platform and participation signifies agreement with any such changes.

    • 16.2. Any user complaints or issues will be duly acknowledged and addressed by the Grievance Officer within the specified timelines under applicable laws.
    • 16.3. All terminologies not defined here but outlined in the Information Technology Act, 2000, and/or the Information Technology (Reasonable security practices and procedures and sensitive personal data or information) Rules, 2011 will bear the meanings assigned therein.
